Book I — General Provisions

Enacted by the Imperial Senate pursuant to the Imperial Charter and granted Imperial Assent by His Imperial Majesty, Emperor Draco Tanos.

Book I establishes the authority, interpretation, jurisdiction, and foundational principles of Imperial criminal law. Its provisions govern the application of the Imperial Code of Justice and guide every court, prosecutor, investigator, public official, and citizen subject to Imperial jurisdiction.

Title I — Foundational Principles

Article 1 — Authority of the Code
This Code establishes the criminal laws, judicial procedures, penalties, and enforcement authorities of the Galactic Empire.

All criminal proceedings conducted within Imperial jurisdiction shall be governed by this Code unless otherwise provided by the Imperial Charter, Imperial Law, an Imperial Edict, or the separate laws governing military justice.

Article 2 — Rule of Law
The Empire shall be governed by law and not by arbitrary action.

All authorities exercising governmental power shall remain subject to the law. No person shall be deprived of life, liberty, citizenship, property, or legal rights except pursuant to lawful authority and due process.

Article 3 — Equality Before the Law
All persons subject to Imperial jurisdiction shall be equal before the law.

No distinction shall be made on the basis of species, ancestry, homeworld, origin, social class, wealth, sex, or political influence.

Nothing in this Article shall prohibit lawful distinctions concerning citizenship status, military service, public office, professional qualification, security clearance, or other matters where a legitimate Imperial purpose requires such distinction.

Article 4 — Preservation of Order
The preservation of public order shall be a primary objective of Imperial Justice.

Courts, prosecutors, law-enforcement agencies, and public officials shall interpret and administer this Code in a manner consistent with maintaining peace, security, justice, and lawful government.

Article 5 — Protection of the Innocent
The protection of innocent persons shall be a paramount responsibility of Imperial Justice.

The Empire recognizes that lawful government exists to protect its citizens from violence, exploitation, corruption, disorder, and criminal conduct.

Article 6 — Accountability
No citizen, public official, military officer, Senator, governor, Minister, judge, corporation, organization, or institution shall stand above the law.

All persons and institutions shall remain accountable for violations of Imperial Law.

Article 7 — Consistency of Justice
Similar offenses committed under similar circumstances shall receive similar treatment under the law.

Courts may consider aggravating and mitigating circumstances where the facts of a case justify distinction.

Title II — Rights of the Accused

Article 8 — Presumption of Innocence
Every accused person shall be presumed innocent until proven guilty according to law.

The burden of proof shall rest upon the prosecution. Guilt must be established by competent evidence presented before a lawful tribunal.

Article 9 — Notice of Charges
No person shall be prosecuted without being informed of the charges brought against them.

Charges shall be stated with sufficient clarity to permit the preparation of a defense.

Article 10 — Right to Counsel
Every accused person shall possess the right to obtain legal counsel.

The Empire may provide counsel in circumstances established by law.

Article 11 — Right to Present a Defense
Every accused person shall have the right to present evidence, call witnesses, challenge evidence, examine testimony, and otherwise defend themselves against criminal accusations.

Article 12 — Right of Appeal
Convicted persons shall possess the right to appeal convictions and sentences as provided by law.

Article 13 — Protection Against Repeated Prosecution
No person acquitted of an offense shall be tried again for the same offense arising from the same conduct, except where substantial new evidence emerges and renewed proceedings are authorized through lawful judicial review.

Title III — Jurisdiction

Article 14 — Imperial Jurisdiction
This Code applies throughout:

• The Galactic Empire;
• Imperial territories and possessions;
• Imperial protectorates where Imperial Law applies;
• Imperial military installations;
• Imperial vessels and stations;
• Imperial diplomatic facilities;
• Any other place placed under Imperial jurisdiction by law, treaty, or Imperial Edict.

Article 15 — Concurrent Jurisdiction
Planetary, system, sector, and regional governments may maintain local legal codes, law-enforcement agencies, and judicial systems.

Where local law conflicts with the Imperial Charter, an Imperial Edict, or Imperial Law, Imperial Law shall prevail.

Article 16 — Extraterritorial Jurisdiction
Imperial Citizens and persons owing lawful duties to the Empire may be prosecuted for certain serious offenses committed beyond Imperial territory.

Such offenses may include:

• High Treason and Treason;
• Espionage;
• Terrorism;
• Piracy;
• Slavery;
• Trafficking in Sapient Beings;
• Crimes against Imperial officials, vessels, installations, or institutions;
• Such additional offenses as may be established by law.

Article 17 — Persons Entering Imperial Territory
Any person entering Imperial territory, boarding an Imperial vessel, using an Imperial installation, or otherwise placing themselves within Imperial jurisdiction shall be subject to Imperial Law.

Article 18 — Official and Military Jurisdiction
Public officials and members of the Imperial Armed Forces remain subject to this Code except where an offense falls within the exclusive jurisdiction of military law or another lawful tribunal.

Title IV — Definitions

Article 19 — Sapient Being
A sapient being is any individual possessing recognized intelligence, self-awareness, reason, and legal personhood under Imperial Law.

Article 20 — Imperial Citizen
An Imperial Citizen is a person recognized by the Galactic Empire as possessing the rights, protections, privileges, and obligations of Imperial Citizenship pursuant to the Imperial Charter and applicable law.

Article 21 — Public Official
A Public Official is any person exercising governmental authority under the Empire, including elected officials, appointed officials, Ministers, governors, judges, prosecutors, military officers, law-enforcement officers, and civil servants.

Article 22 — Organized Criminal Enterprise
An Organized Criminal Enterprise is any association of two or more persons acting together for the purpose of committing serious criminal offenses for profit, influence, power, or unlawful advantage.

Article 23 — Property
Property includes credits, goods, vessels, vehicles, droids, data, records, intellectual creations, real property, commercial instruments, resources, technology, and any other lawful interest capable of ownership or control.

Article 24 — Weapon
A weapon is any object, device, organism, system, or technology designed, modified, or employed to cause injury, death, destruction, incapacitation, or material harm.

Article 25 — Imperial Law
Imperial Law includes the Imperial Charter, Imperial Edicts, statutes enacted by the Imperial Senate with Imperial Assent, lawful regulations, binding judicial decisions, and other lawful enactments recognized by the Galactic Empire.

Article 26 — Effective Interpretation
The provisions of this Code shall be interpreted consistently with:

• The Imperial Charter;
• The rule of law;
• The preservation of public order;
• The protection of Imperial Citizens;
• The lawful authority of the Imperial Throne;
• The principles of Peace, Security, Justice, Order, and Prosperity.

Article 27 — Specific Definitions
Where a term is defined within a later Book, Title, or Article, that specific definition shall govern the interpretation of the offense or procedure to which it applies.
