Imperial Code of Justice

Book IX — Punishments, Corrections, and Rehabilitation

Enacted by the Imperial Senate pursuant to the Imperial Charter and granted Imperial Assent by His Imperial Majesty, Emperor Draco Tanos.

Book IX establishes the lawful penalties available to Imperial courts and governs the correctional system of the Galactic Empire. Punishment exists to protect society, preserve public order, provide justice for victims, deter criminal conduct, and restore offenders to productive citizenship whenever reasonably possible.

Title I — General Sentencing Principles

Article 801 — Purpose of Sentencing
Sentences shall protect society, preserve public order, provide justice to victims, deter future crime, and encourage rehabilitation where practicable.

Article 802 — Proportionality
Punishment shall be proportionate to the seriousness of the offense and the culpability of the offender.

Article 803 — Individualized Sentencing
Courts shall consider aggravating and mitigating circumstances together with the offender's history, the impact upon victims, and the interests of justice.

Title II — Classes of Punishment

Article 804 — Authorized Sentences
Lawful sentences may include admonishment, fines, restitution, probation, community service, restriction of privileges, imprisonment, penal labor, life imprisonment, capital punishment where authorized by law, and any combination permitted by statute.

Article 805 — Restitution
Courts shall order restitution whenever reasonably practicable.

Article 806 — Fines
Monetary penalties shall be proportionate to the offense and the offender's circumstances.

Title III — Community Sanctions

Article 807 — Probation
Courts may suspend all or part of a sentence and place an offender under supervised probation subject to lawful conditions.

Article 808 — Community Service
Courts may order service benefiting the public or local community where consistent with rehabilitation.

Title IV — Imprisonment

Article 809 — Terms of Imprisonment
Imprisonment shall be served in facilities operated or authorized by the Ministry of Corrections.

Article 810 — Classification
Prisoners shall be classified according to security risk, offense, behavior, rehabilitation needs, and public safety.

Article 811 — Rights of Prisoners
Persons lawfully imprisoned retain those rights not lawfully restricted by sentence or institutional security. They shall not be treated as property nor subjected to cruel or arbitrary punishment.

Title V — Penal Labor and Rehabilitation

Article 812 — Penal Labor
Courts may impose productive penal labor as part of a lawful sentence. Such labor shall contribute to restitution, rehabilitation, or the public benefit and shall be administered by the Ministry of Corrections.

Penal labor imposed pursuant to judicial sentence shall not constitute slavery or forced labor prohibited under Book II.

Article 813 — Rehabilitation
The Ministry of Corrections shall provide educational, vocational, medical, and civic programs designed to encourage lawful and productive citizenship upon release.

Article 814 — Good Conduct
Good conduct, restitution, rehabilitation, and exemplary institutional behavior may be considered in determining eligibility for reduced custody or early release where authorized by law.

Title VI — Extraordinary Sentences

Article 815 — Life Imprisonment
Life imprisonment may be imposed for the gravest offenses where authorized by law.

Article 816 — Capital Punishment
Capital punishment may be imposed only for offenses specifically designated by Imperial Law and only following conviction before a competent court with all rights of appeal exhausted or lawfully waived.

The sentence shall require automatic appellate review.

Title VII — Clemency and Restoration

Article 817 — Executive Clemency
The Emperor may grant pardons, reprieves, commutations, restorations of rights, or other acts of clemency for offenses against Imperial Law.

Article 818 — Restoration of Rights
Persons completing their lawful sentences may have civil rights restored in accordance with Imperial Law.

Title VIII — Ministry of Corrections

Article 819 — Administration
The Ministry of Corrections shall administer Imperial prisons, detention facilities, penal colonies, rehabilitation centers, and correctional labor programs.

The Ministry shall ensure sentences are carried out securely, humanely, consistently, and in accordance with the Imperial Charter and Imperial Law.

Article 820 — Inspection and Oversight
Correctional institutions remain subject to inspection by lawful authorities, including the Imperial Inspectorate and other bodies authorized by law.

Title IX — Final Principles

Article 821 — Justice and Mercy
Justice shall be firm, impartial, and consistent. Mercy may be extended where warranted by law, rehabilitation, or executive clemency, but shall never undermine public safety or the rule of law.

Article 822 — Purpose of Corrections
The correctional system exists not merely to confine offenders, but to protect society, encourage lawful conduct, restore productive citizenship where possible, and uphold the ideals of Peace, Security, Justice, Order, and Prosperity throughout the Galactic Empire.
